Aadhaar-PAN Linking
PAN-Aadhaar linking has been mandatory under Section 139AA since 2017, with the latest hard deadline of Mar 31, 2024 (extended multiple times). Missing it makes your PAN 'inoperative' — every TDS deductor switches to the 20% penalty rate (Sec 206AA), banks may freeze accounts, mutual funds reject SIPs, demat accounts go inactive. ₹1,000 reactivation fee currently applies after the deadline (was free during initial windows). Senior citizens 80+ + select foreign citizens are exempt.
Who needs this
Every PAN holder. ~70 crore PAN cards issued; ~52 crore linked as of mid-2024 — ~18 crore still unlinked or inoperative. If you've recently noticed: TDS deducted at 20% on FD interest (vs 10%), bank refused MF SIP, demat account showing 'KYC pending', form 26AS blank — most likely cause is inoperative PAN.

Key decisions
- Q1
How do I check if my PAN is linked + operative?
Go to incometax.gov.in → 'Quick Links' → 'Link Aadhaar Status'. Enter PAN + Aadhaar. Returns: 'Linked' (active) / 'Not Linked — fee ₹1,000 pending' / 'Pending validation' (24-48h). Alternative: login → 'My Profile' → 'Aadhaar Linking Status'. Banks also display status in NetBanking → KYC section. NRIs whose linking is voluntary see 'Not required'.
- Q2
Step-by-step: how to link + pay the ₹1,000 fee?
(1) Pay fee FIRST: incometax.gov.in → e-File → e-Pay Tax → New Payment → Select 'Other Receipts (500)' → AY = current → amount ₹1,000. Pay via NetBanking / debit card / UPI. Save the challan (BSR + serial number). (2) Wait 4-5 working days for fee credit. (3) Link: same portal → e-File → Link Aadhaar → enter PAN + Aadhaar + name (must match Aadhaar exactly) + DOB. (4) Status updates to 'Linked' in 24-48h. Failed validation = name/DOB mismatch — file Aadhaar OR PAN correction first.
- Q3
Why is name mismatch the #1 failure reason?
Aadhaar names follow application format (often includes middle name + suffixes). PAN names follow income-tax application format. Common mismatches: (a) initials vs full name ('R. SHARMA' vs 'RAJ KUMAR SHARMA'), (b) married women — PAN has maiden name, Aadhaar has married name, (c) regional spelling variants ('KRISHNA' vs 'KRISHNAN'), (d) Aadhaar honorifics (DR / SHRI / SMT). Fix: choose ONE to update. Aadhaar correction is faster (UIDAI portal, ₹50, online verification). PAN correction via NSDL Form 49A also works.
- Q4
What's the impact of an inoperative PAN?
Section 206AA: every TDS deductor MUST deduct at 20% (penalty rate) instead of standard 10%/1%/etc. So: FD interest ₹1L = ₹20K TDS deducted (vs ₹10K normal). Property sale: 20% TDS u/s 194-IA on > ₹50L (vs 1%). NSDL/CDSL freeze demat → no buy/sell + dividends stuck. Mutual funds reject SIP / lumpsum / redemption. ITR e-verification blocked. 26AS / AIS visibility issues. Loan applications rejected by most banks. All reversed within 7-10 days of re-linking.
- Q5
Who is EXEMPT from mandatory linking?
Section 139AA(3) carveouts: (a) Non-Resident Indians (NRI), (b) Citizens of any country other than India, (c) Super-senior citizens (80+) at end of relevant FY, (d) Residents of Assam / Jammu & Kashmir / Meghalaya. NRIs are most affected by misinformation — many bank apps still show 'Aadhaar link required' even though IT department doesn't mandate it. NRIs should update PAN status: incometax.gov.in → e-File → 'Update PAN — NRI status flag' to prevent automatic 20% TDS.
