PAN Card

PAN (Permanent Account Number) — the 10-character alphanumeric ID issued by the Income Tax Department — is mandatory for every taxpayer + every meaningful financial transaction in India. Open a bank account / buy property > ₹10L / buy a vehicle > ₹5L / open a demat / invest > ₹50K in MFs — all need PAN. Without it OR with PAN unlinked to Aadhaar, TDS is deducted at 20% (vs the normal section-specific rate, often 1-10%).

Who needs this

Every Indian resident earning above the basic exemption OR doing any of: opening bank/demat accounts, applying for credit cards, buying property/jewellery/vehicles, investing in MFs/stocks, filing ITR, claiming TDS refunds. Minors can have PAN too (for investments in their name). NRIs filing Indian-source income require PAN.

    PAN-Aadhaar linking — still mandatory?

    YES + critical. Per CBDT, every PAN must be linked to Aadhaar by Mar 31, 2024 (extended multiple times). Unlinked PAN becomes 'inoperative' — TDS deducted at 20% (penalty rate) on every transaction. Reactivation: pay ₹1,000 fee + complete linking via incometax.gov.in or via NSDL e-filing portal. NRIs + senior citizens are exempt from mandatory linking, but most banks still ask.

    How to apply for PAN — Form 49A vs 49AA?

    Form 49A: Indian citizens (including resident NRIs returning). Form 49AA: foreign citizens + entities. Apply online at NSDL (protean-tinpan.com) or UTIITSL — fees ₹107 (physical PAN delivered) or ₹72 (e-PAN PDF only). Required docs: Aadhaar (auto-fetch of name/DOB/photo OR manually scanned ID proof + address proof + date-of-birth proof). Processing time: 5-15 days for physical, instant for e-PAN if Aadhaar is e-KYC ready.

    Lost / damaged PAN card — reissue?

    Apply for 'Reprint of PAN Card' on NSDL portal — keeps the SAME PAN number, just generates a new physical card. Fee: ₹50 (India delivery) / ₹959 (international). For loss: file an FIR (some banks ask), then apply for reissue. e-PAN (PDF version) is free + available instantly from incometax.gov.in if your PAN-Aadhaar is linked — no card needed for most uses.

    Surrender duplicate PAN — penalty?

    Having multiple PANs is ILLEGAL under Section 272B — penalty ₹10K per duplicate. If you accidentally got 2 PANs (married name change / state migration confusion), surrender the newer one via Form 49A or a written request to AO (Assessing Officer). Keep the older one active (it has the linked banking + investment history). Online surrender via incometax.gov.in 'Request for New PAN / Change/Correction'.

    PAN for minors + NRIs — different process?

    Minor PAN: apply via Form 49A with parent/guardian's PAN + minor's birth certificate. Card shows guardian's photo (minor's photo + signature added at 18). NRI PAN: same Form 49A — submit overseas address proof (visa / driver's license / utility bill) + Indian-citizenship proof if applicable. NRI PAN can be linked to NRE/NRO bank accounts. Processing typically faster via designated NSDL NRI centres in major cities.

    When is PAN required vs Aadhaar / Voter ID?

    PAN MANDATORY for: bank account opening, mutual fund > ₹50K, demat account, credit card application, property purchase > ₹10L, vehicle purchase > ₹5L, jewellery > ₹2L, hotel/restaurant bills > ₹50K, foreign travel + forex > ₹50K. Aadhaar separately required for KYC. Both PAN + Aadhaar required when linking the two. Voter ID is identity proof only — not a substitute for PAN in tax/banking.

CBDT rules + tax-act references

  • Section 139AA: PAN-Aadhaar linking is mandatory for all PAN holders (subject to exemptions for super-seniors > 80 + select foreign citizens).
  • Section 272B: penalty ₹10,000 for holding multiple PANs or quoting incorrect PAN.
  • Section 206AA: TDS at higher of (a) standard rate (b) 20% if PAN not furnished or PAN is inoperative.
  • Apply / reissue / link only via official portals — NSDL (protean-tinpan.com), UTIITSL (utiitsl.com), or incometax.gov.in. Avoid third-party 'fast-track' services (overcharge, no advantage).
  • e-PAN (digital signed PDF) is legally equivalent to physical PAN card for all uses including bank KYC.
